It is not always in your best interest to hire a personal injury attorney. I realize that, coming from a lawyer, this information may shock you if you have asked the question, “are personal injury lawyers worth it?” Similar to the reasoning behind not going to the emergency room for every cut and scrape, you definitely do not need to hire a personal injury attorney for every fender bender on the Las Vegas roadways.
There are times, however, that you should consult with a Las Vegas personal injury attorney to determine whether or not you should hire him/her. Factors such as the type of injury and how severely you were injured should be considered when determining whether you are going to try to go at it alone or hire an attorney.
In this article we are going to give you some insight to help you determine whether or not you actually need a personal injury attorney. So, let’s start off with some situations where you might not need to hire an attorney:
The Insurance Company Has Already Offered the Maximum Amount Possible
Insurance companies have to limit their personal injury settlements based on how much the insured driver or company was covered for. If the insurance policy of the driver that hit you only covers $15,000 of bodily injury, that is the most that you can ever expect to receive from the insurance company. If the insurance company has already offered you the policy limits, you may not need an attorney unless the amount does not come close to the amount you need to compensate you for your injuries and you can find more money somewhere else.
If the insurance limits for all applicable polls has been exhausted, any additional recovery for the injury would have to come directly from the individual that injured you or from other potentially liable parties. Going after that money would require a lawsuit which can get very complex and expensive. If you find yourself in this situation, you should probably consult with an attorney to better understand your options. If you know that the defendant does not have any money though, your best bet would probably be to accept the settlement and do your best to move on.
You Have Very Minor Injuries
There are times that the injuries that you incurred in an accident are so minor that you won’t need to hire a personal injury attorney. For example, if you get into a Las Vegas car accident and your hand is bruised or you have a few scrapes on your arm, it may not be worth hiring a personal injury lawyer. Injuries that are likely to heal in a few weeks do not need significant medical attention and therefor might not require litigation by an attorney.
However, if after a few days, you realize that the injuries that you can see with your eyes are only the beginning of the injuries that you actually incurred, you may want to reconsider hiring an attorney. If your body begins to ache and movement becomes difficult for you after an accident, you likely have significant soft tissue damage. Proving that you have soft tissue damage and the extent of that damage typically requires an attorney who is proficient in accident-related injuries and skilled at negotiating with insurance companies.
When You Absolutely Need a Personal Injury Attorney
Serious Injuries: If you have an injury that is impacting the way you live, in any way, you should consult with a personal injury lawyer. Getting you compensated for medical bills is only one piece of the puzzle. A great personal injury lawyer will also be able to get you compensation for lost wages, pain & suffering, and for any other negative accident-related impact on your life. Determining how much you should get compensated is part of what personal injury attorneys do.
Can’t Determine Who is at Fault: If there is a question at to who’s fault the accident was, you absolutely should hire a personal injury attorney. The attorney will know which arguments to make and how to prove that the accident was not your fault. When the Insurance Company is Telling You That You Don’t Need One: If your insurance company is telling you that you don’t need a lawyer, you should always suspect its motives. Insurance companies will always try to save a dollar if they can and they know that hiring a personal injury lawyer could end up costing them more money that they would have to pay to you. Consulting with an attorney will not cost you anything and a reputable personal injury attorney will tell you whether or not you have a good case.
